2. Applicable legislation

We process personal data in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), the legislation of the Republic of Cyprus applicable to personal data protection, and other applicable European legislation.

3. What data we may process

Depending on how you interact with olé, we may process the following categories of data.

If you email us or use the contact form

We may process:

  • your email address;
  • your name, when you provide it;
  • the content of your communication;
  • the enquiry type and form language, when you use the form;
  • any other information you choose to provide voluntarily.

We recommend that you do not provide personal information that is unnecessary for handling your enquiry.

If you request a guide or free content

When you request the free guide through the form, we will process:

  • your email address;
  • your chosen guide language, Spanish or English, and the form language;
  • the date and time of acceptance, and the text and version of your marketing consent;
  • the technical information strictly necessary to manage the request and delivery.

We use Emailit to send you the guide in your chosen language and store your subscription and marketing consent details.

To request the guide, you must explicitly tick the box to subscribe to promotional emails from olé. This checkbox is required and is not preselected.

The contact form is separate: sending an enquiry does not subscribe you to promotional communications.

Technical data

When you visit byole.com, certain technical data may be processed automatically by the systems needed to provide and protect the service, such as:

  • IP address;
  • browser type;
  • device and operating system;
  • date and time of access;
  • pages or resources requested;
  • information relating to errors, operation and security.

4. Purposes and legal bases

Responding to your enquiries

We will use the data you provide when contacting us to handle and respond to your communication.

The legal basis may be taking steps at the data subject's request prior to entering into a contract, where the enquiry relates to a potential commercial relationship, or our legitimate interest in handling communications we receive.

Sending you a guide or content you have requested

If you provide your email address specifically to request a free guide or another resource from olé, we will use that address to manage your request and send you that content.

The legal basis will be managing the request made by the user.

The guide form includes an explicit checkbox to accept the promotional subscription, in addition to accepting the privacy policy.

Marketing communications

We will use your email address to send promotional communications from olé based on the consent you give by ticking the relevant checkbox in the guide form.

You can withdraw that consent at any time by emailing info@byole.com.

Operation and security

We may process certain technical data to:

  • provide the Website properly;
  • ensure its security;
  • prevent misuse;
  • detect technical problems;
  • maintain the stability and availability of the service.

The legal basis is our legitimate interest in operating and protecting byole.com properly.

5. Analytics, advertising and profiling

Currently, olé does not use analytics tools intended to track users or advertising pixels.

We also do not carry out profiling or make automated decisions that produce legal effects or similarly significantly affect users.

If this changes, we will update this Policy and, where necessary, obtain the relevant consent beforehand.

6. How long we retain data

Data relating to enquiries will be retained for as long as necessary to handle them and, afterwards, for the periods necessary to meet any legal obligations or liabilities arising from the communication.

Subscription and consent details are retained to manage the promotional communications accepted in the guide form and keep a record of that acceptance.

Technical data will be retained only for as long as necessary for the relevant operational, security and diagnostic purposes.

Where processing is based on your consent, you may withdraw it at any time.
